Will dispute prevents burial of Sherman Hemsley

(AP) ? The embalmed body of actor Sherman Hemsley, who became famous for his role as television's George Jefferson, will be kept in refrigeration at an El Paso funeral home until a local court rules on the validity of his will.

In the will Hemsley signed six weeks before dying of lung cancer July 24 he named Flora Enchinton, 56, whom he called a "beloved partner," as sole beneficiary of his estate, which is estimated in court documents to be more than $50,000.

The will is being contested by Richard Thornton, of Philadelphia, who claims to be Hemsley's brother and says the will might not have been made by the actor.

Enchinton told The Associated Press on Wednesday that she had been friends with Hemsley and had been his manager for more than 20 years. Over the time she, Hemsley and Hemsley's friend Kenny Johnston, 76, lived together, she said he never mentioned any relatives.

"Some people come out of the woodwork ? they think Sherman, they think money," Enchinton said. "But the fact it that I did not know Sherman when he was in the limelight. I met them when they (Hemsley and Johnston) came running from Los Angeles with not one penny, when there was nothing but struggle."

Mark Davis, listed in court documents as Thornton's lawyer in El Paso, did not immediately respond to messages left at his office.

There is no date set for the case to be heard, court officials said. Enchinton said she hopes it will all be cleared in court.

The Philadelphia-born Hemsley played Jefferson in the CBS sitcom "All in the Family," then starred in the spinoff "The Jeffersons" from 1975 to 1985. It was one of TV's longest-running and most successful sitcoms, particularly noteworthy for its predominantly black cast.

Hemsley made George Jefferson ? the bigoted, blustering Harlem businessman ? one of TV's most memorable characters and a symbol for urban upward mobility.

There?s nothing like kicking back with a cold beer while barbecuing. Or maybe there?s nothing like sipping on a porter in front of a fireplace on a rainy day. Whatever the case, I?m really excited about this installment of Driven. It?s not every day that you get to interview a craft brewer.

Four years ago, Nick Garrison brewed his first batch of beer. One batch became two, two became a hobby, and the hobby has now evolved into a full time venture called High Jinx Beer. Nick is currently busy preparing for the brewery?s opening in Rhode Island later this fall.

High Jinx is unique for several reasons: The name and flavor of each High Jinx beer is created around a specific experience. For instance, the Downpour is a porter that pairs perfectly well with a rainy day. And the hops in the Backyahd (that?s ?backyard? for all you non-New Englanders!) enhances the flavor of food from the grill.

You won?t find High Jinx in a bottle. Why?

When did you first get the idea to start a brewery? How has that evolved from an idea to a business?
I started homebrewing a few months before I got married, which was back in June of 2008. What had started as a hobby quickly spiraled into an obsession ? I was spending seemingly every waking hour of my day reading about beer and brewing, honing my homebrewing skills, tinkering with equipment, and also drinking a lot of different beers that I had never tried before to learn about all of the various styles and flavors that encompass beer. I decided that I wanted to brew all of the beer for my wedding, so I brewed numerous batches leading up to the big day and had a nice little selection of craft beers to serve our guests. On the day of the wedding, my wife Sarah and I were walking up from the beach after taking photos (we were married on Cape Cod), and everyone was there waiting to greet us. Coincidentally, almost everyone was drinking my beer. Amidst all of the congratulations and hugs, numerous people told me that the beer was amazing and that I should look into brewing full time. That was when the light bulb went off. The following week, Sarah and I were on our honeymoon in Quebec, enjoying a beer at a nice little brewpub. Sarah turned to me and asked, ?How great would it be to own a place like this?? That was the exact moment in my life when I knew I was going to open a brewery. After the honeymoon, I returned home and started buying books about brewing and entrepreneurship, e-mailing friends who knew people in the brewing industry, and just started writing ideas down on paper. That initial list of ideas evolved into a formal business plan that developed over the course of two years. Just short of four years after my wedding, I closed out our financing and began construction of the brewery.

You quit your 9-5 job to start the brewery. What was that transition like?
It was very strange and foreign to me at first because I suddenly had 100% control over my own schedule. However, it didn?t take me long to settle into a new work rhythm. The starkest contrast between the brewery and my old job is the variety in the work. Rather than sitting behind a desk from 9-5, now on any given day I might be painting walls in the brewery, negotiating with a supplier over the phone, doing accounting work, talking to distributors and retailers, or driving somewhere to inspect equipment. It?s something different every single day, and I really enjoy being my own boss.

How?d you pick the name High Jinx?
I went through a number of different names for the brewery and finally settled on High Jinx because: one, I loved the sound of it, and two, I felt that the name reflected not only our company, but why people ultimately drink beer ? IT?S FUN! High Jinx is playful, a bit mischievous, and there?s sort of an element of surprise behind it. I thought that was a great reflection of our company and the overall experience of opening a brewery.

Have you guys run into any obstacles with getting High Jinx off the ground?
Absolutely, and I know we?ll run into more obstacles in the months ahead (every brewery does). The biggest challenge by far was obtaining financing for the business, particularly as a start-up and in this economic environment. We?ve had a few hiccups during construction as well (things costing more and taking longer to complete than expected) but certainly nothing catastrophic. I think I spent so much time planning and preparing to open High Jinx that I was able to mitigate much of the risk associated with starting a business.

There?s a lot that goes into a beer label and packaging. Can you talk about the inspiration for your package design and branding?
I have an incredibly talented brand artist and friend, Liz Weinberg, who does all of our packaging design, brand artwork, merchandise, website, etc. Liz is a RISD (Rhode Island School of Design) graduate and has an impeccable eye for color and simplicity in design. She?s done amazing work for High Jinx, and I?m lucky to have her helping me out. The jester motif is a perfect fit for High Jinx, and Liz and I developed the idea of using simple symbols to represent each beer experience. Hence the bar stool image for our flagship beer; the rain cloud for our porter, Downpour; and the grill for Backyahd, our IPA. We?ve really strived for simplicity in our packaging designs. I think all too often, breweries try to put too much info on their labels, which can be a bit overwhelming to the beer drinker.

What?s your process for developing new beer flavors?
When we develop our beers, my brewmaster Damase and I start with looking at specific experiences: situations where it would be ideal to drink a beer. Then we start asking questions that help drive the characteristics of the beer itself. Is the experience indoors or outdoors? Do we want the beer to be malty or hoppy? Sweet or dry? Wholesome or refreshing? Where should the raw ingredients come from? What?s the appropriate alcohol content? From there, we settle on a general style, and the recipe starts to take shape.

Is this process different when you?re crafting your seasonal brews?
The only difference is that we?re looking at an overall season as opposed to a single experience. With our seasonals, we?re trying to craft a perfect high-end beer that we think beer lovers would enjoy in that particular season. Also, with their higher alcohol content, our seasonals can be aged. It will be fun to hold onto a bottle of a 2013 seasonal and then compare it to the next year?s version. This is called a vertical tasting.

What?s the partnership with the New Urban Farmers like? Any other initiatives planned for down the road?
So when you?re done brewing a batch of beer, there?s a lot of leftover grain, hops, and protein ? this is called trub. Trub is basically a Thanksgiving dinner for cattle, so we?ve been looking at forming partnerships with local farms who can come pick up the byproducts of the brewing process to feed their cattle or use as compost. It?s really a win-win for everyone?particularly the cows. Beyond that, we?ll be pursuing initiatives that involve other small local businesses and efforts that promote sustainability and ?green? business.?

Once the brewery opens, what?s up next for High Jinx?
President Eisenhower once said, ?Plans are useless, but planning is everything.? I have a lot of plans for the brewery that I?m sure will go right out the window when we open, but the process of preparing a business plan and thinking through challenges and how we?re going to grow our business has been indispensable. In the first few months, our priority is going to be getting our brand out into the marketplace, while ensuring that our production capacity keeps pace with demand. As a new brewery, you have to be careful not to spread yourself too thin and try to be in every single market. We?ll be doing a lot of promotional events in the first few months of business and also hosting tours at our facility. It?s going to be a ridiculous amount of work but also a ton of fun.

Describe your first ever experience with beer.
I think my FIRST experience with beer involved a lot of puking and shame. I?d say I first started to gain an appreciation for good beer in college. My roommate would spend his summers in Michigan and was always talking about the amazing beers out there. It was from him that I started to gain an appreciation for quality beer, even though at the time I didn?t really know anything about how beer was actually made. It wasn?t until I picked up homebrewing as a hobby that I really got ?hooked? and became absolutely fascinated with anything and everything related to beer.

What?s your favorite kind of beer? And what foods do you like to pair it with?
Impossible question! Depends on my mood, the weather, the time of year, and what I?m doing. However, I?ll admit that I hold a special place in my heart for IPAs. Some of my favorite food/beer pairings are ? steamed lobster with a nice refreshing IPA; shepherd?s pie with an English ESB; a juicy cheeseburger with an American pale ale; and of course, oatmeal stout with chocolate cake?delicious.

And finally, do you have any tips to people who want to start homebrewing?
Yes. Go buy a book called ?How to Brew? by John Palmer, or visit his site. There are tons of instructional videos on YouTube as well. You can buy a starter homebrewing system for anywhere between $100-200, either at a local homebrew store or on the web. People who are unfamiliar with homebrewing will be surprised by how easy the process is to master, and more importantly, how rewarding and fun it is to immerse yourself in the world of beer. It?s incredible how much you can learn from homebrewing.

?[Americans] have been told a bunch of terrible things about him ? that he doesn?t care about people like you, that he ships jobs to China, that he?s a wealthy plutocrat married to a known equestrian,? former Republican National Committee chairman Haley Barbour told reporters Monday at an event in Tampa hosted by the GOP polling group Resurgent Republic.

The head of the local government initially said the victims were civilians at a celebration late Sunday involving music and dancing in the Musa Qala district of Helmand province. The official, Neyamatullah Khan, said the Taliban killed the party-goers for flouting the extreme brand of Islam embraced by the militants.

But a provincial government official said later that those killed were caught up in a fight between two Taliban commanders over two women, who were among the dead. Daoud Ahmadi, a spokesman for the provincial government, said shooting broke out during the fight. He said it was unclear whether the music and dancing triggered the violence and whether the dead were all civilians or possibly included some fighters.

Ahmadi said all of the bodies were decapitated but it was not clear if they had been shot first.

In other violence, two American soldiers were shot and killed by one of their Afghan colleagues in the east, military officials said. Afghan officials said the killings appeared to be accidental, however NATO would not comment on the question of whether the killings were intentional or accidental.

The Taliban has controlled large parts of the district of Musa Qala, an area encompassing more than 100 villages, since 2001. They enforce the same strict interpretation of Islamic law that was imposed on all of Afghanistan during Taliban rule of Afghanistan from 1996-2001.

U.S. Marines have battled the Taliban for years in Musa Qala, but the insurgent group still wields in significant power in the area as international forces across the country draw down and hand over control to Afghan forces. Helmand province, where Musa Qala is located, is one of the areas seeing the largest reduction in U.S. troops. The U.S. started reducing forces from a peak of nearly 103,000 last year, and plans to have 68,000 troops by October.

Many Afghans and international observers have expressed concerns that the Taliban will try to re-impose strict Islamic justice as international forces withdraw. Under the Taliban, all music and film was banned as un-Islamic, and women were barred from leaving their homes without a male family member as an escort.

The Taliban spokesman for southern Afghanistan could not be reached for comment on the beheadings.

But a Taliban spokesman Qari Yousuf, who denied the group was involved. "I spoke to our commanders in those villages, but they know nothing of the event," he told Reuters.

In June, Taliban fighters stomed a lakeside hotel near Kabul demanding to know where the "prostitutes and pimps" were during a party, witnesses said. Twenty people were killed.

Canadian dollar firms on euro zone hopes, Fed in focus

TORONTO (Reuters) - The Canadian dollar strengthened against the U.S. dollar on Friday, modestly reversing a recent selloff, after encouraging news out of Europe lifted global economic sentiment.

The European Central Bank is considering setting yield band targets under a new bond-buying program to allow it to keep its strategy shielded and avoid speculators trying to cash in, central bank sources told Reuters on Friday. It's a decision that will not be made before the ECB's September 6 policy meeting, however, they said.

"That definitely helped risk appetite. You saw stocks rally on that and the Canadian dollar rallying a little bit on that as well," said Benjamin Reitzes, senior economist and foreign exchange strategist BMO Capital Markets.

The Canadian dollar closed at C$0.9916 versus the U.S. dollar, or $1.0085, firmer than Thursday's North American session close at C$0.9936, or $1.0064. The currency has come off three-and-a-half-month highs against the greenback reached this week, with currency strategists viewing the currency as oversold.

All eyes will be on U.S. Federal Reserve Chairman Ben Bernanke and other central bank leaders when they meet in Jackson Hole, Wyoming next week for an annual get-together that often hints at what monetary policy is to come.

In a letter obtained by Reuters on Friday, Bernanke told a congressional oversight panel the Fed has room to deliver additional monetary stimulus to boost the U.S. economy.

Also in focus will be Canadian GDP figures, which are expected to be soft, though Reitzes said the numbers will not be bad considering the state of the global economy.

"That being said, it's nowhere near strong enough for the Bank of Canada to start raising rates," he cautioned, noting that yields have been a meaningful driver of the currency in recent weeks.

"If Bernanke signals they're going to ease further, it's not as if the Bank of Canada can go on a hiking parade. There's a limited amount that their policies can diverge," said Reitzes, adding the limitations will cap strength in the Canadian dollar and limit upward pressure on yields.

Canadian bond prices slipped across the curve, with the two-year bond down 4 Canadian cents to yield 1.149 percent and the benchmark 10-year bond losing 1 Canadian cent to yield 1.825 percent.

Daniel Kinberg, a former Navy Corpsman who was diagnosed with an inflammatory joint disease and post-traumatic stress disorder after returning from Afghanistan in 2010.

Daniel Kinberg had not planned on leaving the Navy. The second class petty officer was a reservist who enlisted in 1994 and eventually served as a Navy Corpsman to Marines deployed in Afghanistan's Helmand Province from October 2009 to June 2010.

Kinberg, a medical specialist, was constantly under fire. A suicide bomber struck in a bazaar, killing one of Kinberg's closest friends, and he was the first to respond. When the vehicle of his sergeant major was struck by an improvised explosive device, he could not attempt a rescue as it burned. He was often approached by Afghans who needed medical attention for their injured or dying children.

The deployment took a physical and mental toll on Kinberg, who is 40 and lives in San Diego. "We were always fearing for our lives every second and not knowing if the next step you take is going to be your last," he told NBC News.


He returned from the deployment with terrible back pain, which he attributes to frequent dives for cover and daylong foot patrols in rugged terrain with a full combat load. He was soon diagnosed with ankylosing spondylitis, a disease characterized by inflammation in the spinal and pelvic joints. The disease can be hereditary, but Kinberg did not experience symptoms until during combat.?

When a doctor said in June 2010 that he could not be deployed again as a result, it was a "tough blow." A few months later, after having trouble reintegrating, Kinberg was diagnosed with post-traumatic stress disorder.

The yearlong battle that followed, however, as Kinberg attempted to retire from the Navy with disability and medical benefits, was more difficult than he could have imagined. At first, the military denied him a retirement with full benefits, arguing that the PTSD and ankylosing spondylitis pre-existed his service.

Experts who appeal cases like Kinberg's say his is one of many in which the military may wrongly try to separate an injured service member without benefits. Even if a service member is given a favorable decision, the average wait in each of the services is a year or longer, and most are left trying to navigate in a bureaucratic system that is not always kind to those who will never deploy again.

Last month, the disability system was criticized in a Congressional hearing for the long waits. As of late July, there were more than 26,000 open cases across the Army, Air Force, Navy and Marine Corps. In the Army, which accounts for two-thirds of the caseload, service members wait the longest at an average of 427 days; the goal set by the Departments of Defense and Veterans Affairs is to process active-duty cases in 295 days.

Medical retirement has been under Congressional scrutiny since 2007, when several commissions revealed that service members were frequently denied legitimate disability benefits and that an outdated processing system resulted in waits as long as 540 days. Since then, policies issued by DOD as well as Congressional legislation have resulted in significant improvements, primarily the streamlined process known as the Integrated Disability Evaluation System (IDES), which allows DOD and VA to jointly assess medical conditions and disability ratings.

Veterans advocate Michael Parker, a former lieutenant colonel in the Army who estimates assisting on hundreds of disability cases in the past seven years, said that while the changes have led to better outcomes, many service members like Kinberg continue to be denied legitimate but costly benefits.

Service members often approach Parker, who is not a lawyer and does not charge a fee, after they're found fit to serve despite severe injuries, or if the military or VA has ruled the condition in question does not deserve a disability rating high enough to qualify for benefits; the threshold is 30 percent.

"Somebody will come to me and say, 'My case is broken, can you help me?' " Parker told NBC News. "Every day there is a new situation that is counter to taking care of wounded people."

Parker has seen cases in which the military "cherry picked" from a number of injuries, selecting the least aggravated one and assigning it a disability rating that did not qualify for full benefits upon retirement.?

He has also seen a range of perplexing cases, including a combat Marine who in 2010 was first found unfit due to service-related disabilities, but not at a 30 percent rating. The decision was then reversed and he was found fit for duty, but he was subsequently separated without benefits. When he tried to re-enlist, the Marine was denied on the grounds that his conditions disqualified him for service.

Congress soon passed laws prohibiting the military from discharging a service member due to a condition for which he or she had been previously evaluated and found fit for duty. Parker said the legislation is important, but that the military has found different ways to withhold disability benefits; he has handled cases where service members are administratively discharged for a service-connected disability before they even enter or complete IDES.

Daniel Kinberg was prepared for a difficult process. ?I never heard a good thing about it,? he said. ?Everyone says this is a nightmare.?

Kinberg's medical conditions were assessed by a three-person physical evaluation board (PEB), which found him unfit for duty as a result of the ankylosing spondylitis and PTSD, but said that both conditions were pre-existing. Specifically, the board indicated that the PTSD may have been tied to his ankylosing spondylitis, not combat. His case was sent to VA to receive a disability rating, and it returned a different decision: the PTSD was service-connected and received a 100 percent rating, which would have allowed him to retire with full benefits.

The Navy, however, disagreed, and enforced its original finding that the conditions pre-existed service ? without providing evidence to prove its case as required by law. Kinberg would be separated from the military with no DOD medical or disability benefits, though he would receive VA care and benefits.

"It?s a slap in the face," Kinberg said of the decision. "I know I?ll never be the same as I was before ... I used to be this happy guy and I don?t see me ever getting there."?

With Parker's representation, Kinberg appealed the decision. First, Parker convincingly argued that neither condition was pre-existing, but then the PEB reversed its original decision and found that the PTSD did not make Kinberg unfit for duty, which again prevented him from receiving a rating high enough for DOD benefits.

In May, Parker successfully appealed that decision before the Navy's physical evaluation board in Washington, D.C. In the end, the board agreed that both conditions were service-connected and made Kinberg unfit for duty, awarding him a 100 percent rating for PTSD, and as a result, a full DOD medical retirement.

In very rare cases, DOD told NBC News, the military can "depart" from a VA rating when approved at a high level. DOD said it did not know of cases in which the military did not follow the VA finding, but there is also no requirement to report those incidences.

Jason Perry, a former Army captain in the Judge Advocate General Corps who now assists service members with disability retirement cases, told NBC News that despite improvements to the medical retirement process, the system still seems "arbitrary."?

Often, Perry will see two cases with the same underlying facts, but different decisions. One service member will receive a high disability rating while another gets a substantially lower one.

DOD told NBC News that criteria for judgments differ across the services depending on the type of missions and fitness required of the service member.

Perry said, however, that the discrepancies are partly due to the subjectivity of individual doctors as well as the three-person panel that evaluates the merits of each medical retirement case.

Complaints like these are common on PEBforum.com, a website Perry founded that allows service members to glean intricacies of the process, ask other posters about their cases and learn how to avoid common pitfalls or mistakes.

Perry, who has handled 400 cases as a former Army captain and a for-hire lawyer over the past six-and-a-half years, doesn't believe those who serve on PEBs set out to "low ball" or deny benefits to service members. Instead, he thinks they're attempting to follow the rules, but often make errors in judging whether an injury is service-connected and is worthy of a full medical retirement.

Though designed to keep malingerers from taking advantage of the system, stringency for disability claims can prevent worthy cases of getting a proper ruling.

In Kinberg's case, he felt under constant scrutiny. While on medical hold, he was tasked with driving a shuttle for patients, a duty that too often triggered his PTSD symptoms of hyper-vigilance and irritability.

Instead, he signed up for vocational rehabilitation, a skills-based training program for those with service-connected disabilities, but that was cited as evidence by the PEB that his PTSD was not severe enough to make him unfit for duty. Yet, in Kinberg's opinion, it was the vocational rehabilitation that gave him a crucial "sense of fulfillment" to endure the yearlong wait for a decision on his case.

He also worried about taking advantage of community events and activities held for wounded warriors, fearing his participation might undermine his diagnosis in the eyes of the PEB.

"I didn?t do any of that stuff because I was already warned," he said, referencing advice given to him by other service members.

"It?s a long, drawn out process," Kinberg said of IDES and remaining on medical hold. "Unless you do something with your time there, it?s a very miserable existence. I know people who are suicidal because they don?t have anything going on in their life and they're just sitting in their room and going to doctor?s appointments."?

In the July Congressional hearing, VA Secretary Eric Shinseki defended the length of the decision process, explaining that much of that time was necessary for wounded service members to convalesce and receive appropriate medical attention.

However, a report on IDES published by the Government Accountability Office in May found significant delays in completing medical examinations; in 2011, only 31 percent of active-duty cases met the 45-day goal. Officials told GAO that case loads were large and that there were not enough doctors to complete paperwork in a timely manner. The report noted that the Army was in the midst of doubling its staffing for medical evaluations to address the delays.

Neither Parker nor Perry want the timeline goals achieved at the detriment of getting the process right. However, Perry said, long waits can lead to frustration for service members who have no ability to plan for the future, whether it be lining up civilian employment, enrolling in college, or knowing where their children will attend school in a year.

While the delays receive the most attention, there also appears to be a dangerous disconnect between the wounded and their command in some cases.

The Recovering Warrior Task Force, a panel that gives DOD recommendations on policies related to the treatment of the injured, found in the course of conducting focus groups with wounded service members that they often encountered an "adversarial dynamic ... which distracts them from focusing on healing."?

The task force wrote in a draft report earlier this year that the Army and Marine Corps might consider how to prevent transition staff from behaving in counter-productive ways, including acting or speaking to injured service members "in a demeaning or hostile way, accusing (them) of malingering in the course of their recovery, breeching privacy by discussing medical and personal matters ..."

Kinberg, who was among a handful of combat-wounded sailors in his medical hold unit of 50 people, witnessed that dynamic. Kinberg said his chain of command included activated reservists who had never been deployed and acted at times as though members of the unit were faking injuries.

Despite these troubling experiences, Kinberg is preparing to move on. The internship he secured through vocational rehabilitation has led to a job, which he will begin after being discharged from the Navy this month. Still, he can't quite fathom his experience in the disability retirement system.

"I thought some people weren?t doing something right," he said. "I did everything by the books, by the numbers and still they come back and say, 'Well you?re zero.' "?

"I was somewhat prepared, but I didn?t think it would happen to me."?
